| ADELAIDE TESTING MACHINES INC. warrants the equipment against defects in material or workmanship for a period of 12 (twelve) months from date of shipment. All repair and replacements FOB ADELAIDE TESTING MACHINES INC. factory. On site repairs, where possible, will be made under Warranty exclusive of travel expenses incurred. The Warranty does not cover expendable items such as but not limited to hydraulic oil, filters, seals, fuses, computer printer ribbons, ink jet cartridges, or computer diskettes. |

| Computer software copyrighted by ADELAIDE TESTING MACHINES INC. shall not be copied or distributed without written permission. in addition, buyers may not attempt to reverse engineer or modify any compiled code supplied with the equipment. |

| ADELAIDE TESTING MACHINES INC. assumes no liability for damages arising from the installation or use of components, equipment, or computer software supplied to its customers. In particular, ADELAIDE TESTING MACHINES INC. does not assume liability for the following: |
|
| a) failure or damages to equipment due to misuse, abuse or use in abnormal conditions of temperature, dirt, or corrosives. |
| b) operation which is not in accordance with the operating manual. |
| c) operation above the rated capacity of the machine. |
| d) damage due to disassembly or attempted repair, or modification by unauthorized personnel. |
| e) failure to properly maintain the equipment or to follow normal periodic maintenance required to ensure proper operation of mechanical equipment. |

| In addition, ADELAIDE TESTING MACHINES INC. shall not be liable to buyer for consequential, incidental, collateral damages of any kind. |
|
| In no instance will ADELAIDE TESTING MACHINES INC. be liable for any value beyond the amount paid for the equipment. |
